1. Acceptance of Terms

By downloading, installing, or using Bitcut ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Bitcut ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the App after such changes constitutes acceptance of the revised Terms.

You represent that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Bitcut is an iOS video editing application designed for creating short-form video content. The App provides the following capabilities:

  • Video Editing: Timeline-based editing with clip trimming, transitions, and beat synchronization.
  • AI-Powered Features: Automatic transcription, text correction, subtitle generation, smart clip segmentation, social media description generation, and AI Story Director.
  • Face Tracking: Automatic face detection and vertical reframing (9:16 from 16:9 source video).
  • Subtitle System: Word-level subtitles with karaoke mode, multiple animation presets, and customizable styling.
  • Cloud Storage: Upload finished Shorts and receive shareable links for distribution.
  • Multi-Language Support: AI transcription and translation across multiple languages.

The App requires iOS 17 or later and is available on iPhone and iPad. Certain features require an active internet connection and may consume cellular data.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account and Registration

Bitcut uses device-based authentication. When you first launch the App, a unique identifier is generated and associated with your device. This identifier is used to manage your subscription status, usage quotas, and cloud storage.

You may optionally sign in with Apple to link your account across devices. When you use Sign in with Apple, we receive only the information Apple provides (which may include a relay email address), and we use it solely for account identification and recovery purposes.

You are responsible for maintaining the security of your device. Any activity that occurs under your device identifier or linked account is your responsibility. If you believe your account has been compromised, contact us immediately at support@bitcut.app.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscriptions and Payments

4.1 Plans

Bitcut offers the following subscription tiers:

  • Free: Full editor access, beat sync, transitions, up to 30 minutes of AI processing per month, and export with watermark.
  • Pro ($9.99/month or $99.99/year): No watermark, 300 minutes of AI processing per month, face tracking and auto-reframe, and 5 GB of cloud storage.
  • Creator ($19.99/month or $199.99/year): 1,000 minutes of AI processing per month, AI Story Director, multi-language transcription and translation, and 50 GB of cloud storage.

Prices are in US dollars and may vary by region. We reserve the right to change pricing at any time. Price changes will not affect active subscription periods.

4.2 Apple In-App Purchase

Subscriptions may be purchased through Apple In-App Purchase. These transactions are governed by Apple's terms and conditions. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

You can manage and cancel your subscriptions by going to your Apple ID account settings on your device. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

4.3 Refunds

For subscriptions purchased through Apple In-App Purchase, refund requests must be directed to Apple in accordance with their refund policy. We process refund requests in accordance with applicable consumer protection laws.

4.5 AI Processing Quotas

Each subscription tier includes a monthly allocation of AI processing minutes. Unused minutes do not roll over to subsequent billing periods. AI processing minutes are consumed when using transcription, text correction, subtitle generation, AI segmentation, description generation, and related AI features. Usage is tracked per calendar month and resets at the beginning of each billing cycle.

5. User Content

5.1 Ownership

You retain full ownership of all content you create, edit, import, or export using Bitcut ("User Content"). Bitcut does not claim any ownership rights over your User Content. Your videos, audio, subtitles, edits, and exported files remain entirely yours.

5.2 License Grant

By uploading User Content to Bitcut's cloud storage or using our AI processing services, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, transmit, and process your User Content solely for the purpose of providing and improving the Service. This license exists only for as long as your content remains on our servers and terminates when you delete your content or your account is terminated.

5.3 Responsibility for Content

You are solely responsible for your User Content and the consequences of uploading, publishing, or sharing it. You represent and warrant that:

  • You own or have the necessary rights, licenses, and permissions to use and authorize Bitcut to process your User Content.
  • Your User Content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, or other legal rights.
  • Your User Content complies with all applicable laws and regulations.

6. Cloud Storage

6.1 Storage Limits

Cloud storage is available to Pro and Creator subscribers. Storage limits are determined by your subscription tier: 5 GB for Pro and 50 GB for Creator. Free users do not have access to cloud storage. If your subscription expires or is downgraded, existing files will be retained for a grace period of 30 days, after which they may be permanently deleted.

6.2 Published Content

When you publish a Short to cloud storage, Bitcut generates a shareable link that allows anyone with the link to view and download the video. You are solely responsible for the content you publish and the links you share. Published content is accessible to anyone who possesses the link — treat shared links with the same care as any publicly accessible URL.

6.3 Content Removal

You may delete your published Shorts at any time through the App. Deleted content will be removed from our servers and the associated shareable links will cease to function. We reserve the right to remove content that violates these Terms, applicable law, or our content policies, with or without notice.

6.4 Data Integrity

While we take reasonable measures to protect stored content, we do not guarantee against data loss. You are responsible for maintaining local copies of any content you upload to cloud storage. Bitcut is not liable for any loss or corruption of uploaded content.

7. AI Features

7.1 Processing

Bitcut's AI features include speech-to-text transcription, text correction, subtitle generation, intelligent clip segmentation, social media description generation, multi-language translation, and AI Story Director. These features process your audio and video data on our servers using machine learning models.

7.2 Accuracy

AI-generated outputs (transcriptions, translations, descriptions, segmentation decisions, and subtitles) are produced by automated systems and may contain errors, inaccuracies, or omissions. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. You are responsible for reviewing and editing AI outputs before publishing or distributing them.

7.3 Data Handling

Audio and video data uploaded for AI processing is used solely for the purpose of generating the requested output. Uploaded audio files are stored temporarily during processing and are deleted after the processing job is complete. We do not use your content to train or improve AI models.

7.4 Third-Party AI Services

Certain AI features may utilize third-party services for text processing and correction. By using these features, you acknowledge that your content may be processed by third-party systems subject to their own terms and privacy policies. We select our partners carefully and require them to handle data in accordance with applicable privacy standards.

8. Prohibited Use

You agree not to use Bitcut for any of the following purposes:

  • Creating, distributing, or storing content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Creating content that exploits minors in any way, including child sexual abuse material.
  • Infringing upon the intellectual property rights of others, including unauthorized use of copyrighted music, video, or images.
  • Distributing malware, viruses, or any other harmful software through the Service.
  • Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
  • Circumventing, disabling, or interfering with any security, authentication, or usage-tracking features of the App.
  • Using automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable use or places undue burden on our infrastructure.
  • Impersonating any person or entity, or falsely claiming an affiliation with any person or entity.
  • Using the AI features to generate spam, misleading content, or deepfakes intended to deceive.
  • Reselling, sublicensing, or commercially redistributing the Service or any output from the AI features without authorization.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending accounts, and reporting to law enforcement authorities.

9. Intellectual Property

9.1 Bitcut's Rights

The App, including its design, code, features, user interface, graphics, logos, trademarks, and all associated intellectual property, is owned by Bitcut and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App beyond the limited right to use it in accordance with these Terms.

9.2 Your Rights

As stated in Section 5, you retain full ownership of all User Content. Nothing in these Terms transfers your intellectual property rights to Bitcut. Videos, edits, and exports you create using the App are yours to use, distribute, monetize, or license as you see fit, subject to any third-party rights in the source material you use.

9.3 Feedback

If you provide us with feedback, suggestions, or ideas regarding the App or Service ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate such Feedback into the Service without any obligation or compensation to you.

10. Disclaimer of Warranties

THE APP AND SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BITCUT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

  • The App will meet your specific requirements or expectations.
  • The App will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the App (including AI-generated outputs) will be accurate, reliable, or complete.
  • Any errors in the App will be corrected.
  • The App will be compatible with any particular third-party software, hardware, or services.

You use the App at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BITCUT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP OR SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF BITCUT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL BITCUT'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO BITCUT IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

12. Termination

You may stop using Bitcut at any time by deleting the App from your device and cancelling any active subscriptions through your Apple ID account settings or the applicable payment provider.

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

  • Violation of these Terms or any applicable law.
  • Engagement in fraudulent, abusive, or illegal activity.
  • Extended periods of inactivity.
  • Discontinuation of the Service.

Upon termination, your right to use the App ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.

If your account is terminated, content stored in cloud storage will be retained for 30 days following termination, after which it may be permanently deleted.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bitcut operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the use of the App shall be resolved through good-faith negotiation between the parties. If a resolution cannot be reached through negotiation within 30 days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction, as permitted by applicable law.

You agree that any claim or cause of action arising out of or relating to these Terms or the App must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we may provide additional notice through the App or via email (if available).

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and cancel any active subscriptions.
